Terms and Conditions

The terms on which original paintings are sold through this website. Version of 29 September 2026.

Scope and seller

These terms apply to every purchase made through argenitafetahu.com. The seller is the artist herself: Argenita Fetahu, Weitblick 10, 6038 Gisikon, Lucerne, Switzerland. Email: info@argenitafetahu.com.

The Shipping and Returns page forms part of these terms. How personal data is handled is set out in the Privacy Policy.

Every work is unique

Each painting is a hand-painted original in oil on canvas and exists only once. It is signed, sold unframed and comes with a signed certificate of authenticity.

Colours on screen are an approximation: every screen renders paint differently, and a photograph cannot carry the surface of an oil painting. The texture of the paint, the brushwork and small irregularities of the canvas are part of the work and not defects. Further photographs of any work can be requested before ordering.

How a contract is concluded

The works shown on this site are an invitation to make an offer, not a binding offer. To buy a work, the buyer adds it to the basket, enters billing and delivery details at checkout, can review and correct every entry before submitting, accepts these terms and completes payment. Submitting the order is the buyer’s offer to buy.

The contract is concluded when the order is confirmed by email, which is sent automatically once payment has been received. Until then an order may be declined, in particular if the work has meanwhile been sold elsewhere, for example at an exhibition. Any payment already made is then refunded in full without delay.

The contract language is English. The order confirmation email is the record of the contract and is worth keeping.

Prices, shipping and taxes

Prices are set and charged in Swiss francs (CHF). Euro amounts shown on the site are an indicative conversion at a stored exchange rate, offered as a guide while browsing. The amount charged is always the franc price; any conversion by the buyer’s bank or card issuer is made at its own rate and fees.

Prices are final and include any Swiss value added tax (VAT) due. Shipping is not included: crating, packing and insured delivery are charged separately, depending on the destination and the size of the work, and the cost is shown at checkout before payment.

For deliveries outside Switzerland the buyer is the importer. Import VAT, customs duties and clearance fees charged by the destination country are not included in the price and are paid by the buyer, usually to the carrier on delivery.

Payment

Payment is due in full when the order is placed, by one of the methods offered at checkout. Card payments are processed by WooPayments, powered by Stripe; card details are entered with the payment provider and are never stored on this site.

Where bank transfer is offered and chosen, the work is reserved when the order is received and dispatched once the transfer has cleared. If the transfer has not arrived within ten days, the order is cancelled and the work is offered for sale again.

Delivery and transfer of risk

A work is normally dispatched within five to ten working days of cleared payment. The Shipping and Returns page describes packing, delivery and customs.

By way of exception to Art. 185 of the Swiss Code of Obligations (CO), the risk of loss or damage passes to the buyer only when the work is delivered. Until then a work lost or damaged in transit is the seller’s risk, and is covered by the transit insurance.

Ownership passes to the buyer when the work is handed over at the delivery address, the price having been paid in full in advance.

Copyright and the artist’s rights

Buying a painting transfers ownership of the physical work, not the copyright in it. Under Art. 16 para. 3 of the Swiss Copyright Act (CopA), transferring ownership of a copy of a work, even of the original, does not transfer any right to use the work. The artist keeps all rights of reproduction, publication and adaptation. The buyer may not reproduce the work commercially, make prints or copies of it, or use its image in advertising without her written consent.

The buyer may display the work, lend it for exhibition and sell it, and may photograph it for private purposes, for insurance and in connection with a resale or an exhibition, with credit to the artist. The artist may photograph the work before dispatch and continue to reproduce it in her portfolio, on this website, in publications and in exhibition material.

Under Art. 15 CopA, the owner of an original of which no other copies exist may not destroy it without first offering it back to the artist, for no more than its material value, where she has a legitimate interest in its preservation.

Warranty

The statutory warranty for defects under Art. 197 ff. CO applies. The buyer must inspect the work on delivery and report any defect promptly (Art. 201 CO). Damage in transit should be reported within seven days, as described on the Shipping and Returns page. Warranty claims become time-barred two years after delivery (Art. 210 CO).

Changes caused by the natural ageing of oil paint and canvas, or by handling, hanging, climate or cleaning after delivery, are not defects.

Returns

A work may be returned within fourteen days of delivery, as set out on the Shipping and Returns page. Swiss law gives no general right to withdraw from a purchase made online; this return right is offered voluntarily, in addition to the statutory warranty. It does not restrict any more extensive right of withdrawal that a consumer has under the mandatory law of their country of residence.

Liability

The seller is liable without limitation for damage caused intentionally or through gross negligence (Art. 100 CO), and wherever mandatory law allows no limitation. Otherwise, liability in connection with a sale is limited to the price paid for the work, and there is no liability for indirect or consequential loss.

Governing law and jurisdiction

These terms and every contract concluded under them are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

The courts at the seller’s place of residence in the Canton of Lucerne have jurisdiction. For consumers, the mandatory rules on jurisdiction and applicable law are reserved: in particular Art. 32 and 35 of the Swiss Civil Procedure Code, Art. 114 and 120 of the Federal Act on Private International Law, the Lugano Convention, and the mandatory consumer protection of the buyer’s country of residence.

Changes to these terms

These terms may be updated. The version published on this page when an order is placed applies to that order.
